Terms and Conditions

We are Rook College Prep, Inc. (“Company,” “we,” “us,” “our”), a corporation registered in the Commonwealth of Massachusetts, United States.

We operate the website rookcollegeprep.com (the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Rook College Prep, Inc., concerning your access to and use of the Services. By accessing the Services, you confirm that you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH THESE LEGAL TERMS, YOU MUST DISCONTINUE USE IMMEDIATELY.

We may provide notice of material changes to the Services or Legal Terms via email or via an update posted on the Site. Your continued use of the Services following such notice constitutes your agreement to the revised terms.

The Services are intended for users at least 13 years of age. Minors (generally under 18) must have parent or guardian permission to use the Services.

We recommend printing a copy of these Legal Terms for your records.

Our Intellectual Property

We own or license all intellectual property rights in the Services, including but not limited to source code, databases, software, text, images, designs, trademarks, and logos (collectively, “Content” and “Marks”). These are protected by U.S. and international intellectual property laws.

You may use the Services for personal, non-commercial purposes only. No Content or Marks may be copied, distributed, displayed, sold, or exploited without our prior written consent. Unauthorized use will terminate your right to use the Services and may subject you to legal liability.

Your Use of the Services

We grant you a non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these Legal Terms.

You agree not to engage in prohibited activities including but not limited to data scraping, impersonation, spreading malware, infringing intellectual property, or using the Services for unauthorized commercial purposes.

Your Submissions

Any questions, feedback, or ideas you submit to us (“Submissions”) become our property. By sending us Submissions, you agree to grant us a royalty-free, irrevocable, worldwide license to use, reproduce, and share them without compensation to you.

You are responsible for the legality and originality of all Submissions. Submissions must comply with our standards and must not violate any third-party rights or laws.

User Representations and Registration

By using the Services, you confirm:

Your registration info is accurate and up-to-date.
You are at least 13 years old.
If under 18, you have parental permission.
You will comply with all applicable laws.
You will not misuse the Services.

Purchases and Payments

All services must be paid in full upfront unless otherwise agreed in writing. Payments are accepted in U.S. dollars.

We reserve the right to correct pricing errors, change rates, or refuse any order at our discretion.

Refund and Cancellation Policy

We do not issue refunds except at our sole discretion. To request a refund, email us at rookcollegeprep@gmail.com with a detailed explanation. If approved, we will deduct service and administrative costs and apply a 20% cancellation fee from the total contract price. Refunds are processed within 14 business days.

Cancellations or no-shows within 24 hours of a scheduled meeting will incur a $100 fee. If you arrive more than 15 minutes late, the session may be forfeited.

We understand emergencies happen—please notify us in advance when possible.

Prohibited Activities

You may not use the Services to:

Exploit, harm, or harass others
Post offensive or misleading content
Violate laws or intellectual property
Circumvent security features
Spam or collect user data without consent

We reserve the right to terminate or suspend access for any violations.

User Contributions

Currently, we do not offer public forums or contribution sections. If that changes, users will be required to follow all standards set out in these Legal Terms.

Third-Party Links and Content

Our Services may link to external websites or include third-party content. We do not control or endorse such content and are not responsible for your use of third-party services or websites.

Dispute Resolution

Before taking legal action, we encourage both parties to resolve disputes informally. Please email us to initiate this process.

Binding Arbitration

If unresolved, disputes shall be settled by binding arbitration under AAA rules. Arbitration will occur in Norfolk County, Massachusetts, unless both parties agree otherwise. You waive your right to a jury trial or class action.

Exceptions

Claims involving intellectual property violations, privacy breaches, or injunctive relief may be litigated in court.

Limitations of Liability

We are not responsible for indirect, incidental, or punitive damages, including lost data or lost opportunity. Our total liability to you shall not exceed the amount you paid in the three (3) months preceding the event giving rise to liability.

We do not guarantee admission to any school or university. Our services are informational and advisory in nature. You accept all risks related to college admissions outcomes.

Indemnification

You agree to indemnify and hold harmless Rook College Prep, Inc. and its team from any claims, damages, or liabilities arising from:

Your use of the Services
Your breach of these Legal Terms
Any violation of third-party rights

User Data

We retain data as needed to operate the Services. While we perform regular backups, you are solely responsible for saving your own content. We are not liable for data loss or corruption.

Electronic Communications

By using our Services, you consent to receive communications and notices electronically, including via email or website postings. You agree that digital records and electronic signatures carry the same legal effect as written documents.
